Information for Buyers and Sellers

This page provides information on the rules and guidelines for all sellers and buyers that are interested in participating at our auctions. For further details not listed here, please contact us directly.

For Buyers:

1. Buyer shall register at the office of Lamoni Produce Auction LLC for a buyer’s identification number. Registration consists of buyer’s company or personal name, address, telephone number, driver’s license, and name of person(s) responsible for purchase and payment of product.

2. Sales tax – Iowa State sales tax is collected on all ornamentals – unless a valid IA State Sales Tax Resale Exemption form is on file. A copy of your sales tax number certificate is helpful. Out of state buyers must file the form as an exempt out of state buyer.

3. Buyer’s number is to be used whenever a purchase is made at the Lamoni Produce Auction. Buyer number is only good for that day (Unless permanent account is set up) – please turn in your number card when you are done buying for the day.

4. Items are sold in the quantities announced. Many items will be “times the money” and you must buy the minimum amount offered. There are large, medium and small lots to accommodate a variety of buyers.

5. Buyer is responsible for the inspection of quality and grading of produce offered for sale and will place their bid accordingly. All items are sold as is, where is and become the property of the highest bidder as soon as bidding on that item has ended.

6. In a situation where the seller has misrepresented the quality of his product by deceptive packaging, the general manager of Lamoni Produce Auction shall serve as arbitrator in negotiating settlement. Settlement must be made before produce has been removed from the premises of Lamoni Produce Auction.

7. Buyer shall remove from premises all products purchased on the day of sale or other arrangements must be made. Lamoni Produce Auction will not be responsible for any product not removed immediately after the sale.

8. Buyer shall pay in full for all products purchased on the day of sale, unless credit terms are established with Lamoni Produce Auction.

9. Buyers shall pay with cash or approved check or credit card. Payment shall be made the day of sale as soon as auction is over. Credit card payments are subject to a 3% processing fee. Checks dishonored by the bank shall have a fee of $35 per return and a 2% monthly interest charge until paid. Buyer privileges may be revoked, according to decision of Lamoni Produce Auction management.

10. Credit accounts shall be accepted only if approved by Lamoni Produce Auction LLC office manager. Credit balances shall be completely paid within 10 days of purchases, unless other arrangements have been made with Lamoni Produce Auction office manager. All invoices must be signed after each auction.

11. By registering for a buyer’s number, the buyer agrees to the terms set forth above.

12. THERE IS A 10% BUYERS PREMIUM ATTACHED TO THE FINAL HAMMER PRICE OF ALL PRODUCE BOUGHT. PLEASE FACTOR THIS INTO YOUR BIDDING.

NOTATIONS TO BUYERS – ITEMS ARE SOLD BY THE UNIT – EACH, FLAT, BUNCH, DOZEN, BOX, ETC.

For Sellers:

1. Registration consists of seller’s name, address, telephone number.

2. Seller’s number is to be used on all lots of product offered for sale at Lamoni Produce Auction LLC. This number will identify your lots for payment , so be sure the number is correct & legible on your tickets.

3. Seller is responsible for the unloading, stacking & labeling of their product.

4. Seller is responsible for the proper grading & packaging of their product to the standards set forth by Lamoni Produce Auction LLC. (Check with management for guidelines)

5. Lamoni Produce Auction LLC reserves the right to refuse to sell any product of inferior, poor condition or quality, improperly packaged, or weight inconsistency. This is determined through the management of Lamoni Produce Auction LLC.

6. Where a clear misrepresentation of product has been made, Lamoni Produce Auction LLC reserves the right to withhold payment until proper restitution has been made by the seller. Management will negotiate.

7. Checks will be issued in payment for product sold, less the appropriate commission at the Lamoni Produce Auction LLC for product sold for the auction week & available the first sale of the following week at the office. Checks will be mailed at the beginning of each new month, if not picked up in the previous month. Special mailings will be made only after prior arrangements are made with the office manager.

8. Seller’s shall pack their product in new or good used box. Product packed in non-vegetable boxes or box not suitable for the product is not acceptable

9. By registering for a seller’s identification number, seller agrees to the terms set forth.

10. Seller’s commission will be 10% on final hammer price of their product.
